Jacques Fath Parfums (a brand of Panouge SAS)
1. Scope and Acceptance
Sales of Jacques Fath Parfums products (“Products”) by Panouge SAS (“Jacques Fath Parfums”, “we”, “us”) to end customers (“Customer(s)”, “you”) through our boutique at 12 Avenue Victor Hugo, 75116 Paris and authorized points of sale are governed by these Terms and Conditions of Sale (“Terms and Conditions”).
Products are sold for strictly personal use. Any resale or distribution of Products purchased is strictly prohibited.
2. Product Availability
To ensure the availability of our Products to all our customers, Jacques Fath Parfums reserves the right to limit the quantity of Products purchased per person, per household, or per order.
All orders are subject to the availability of Products.
3. Purchase Terms
Product prices are indicated in euros (EUR) and include applicable taxes (VAT included). Shipping fees, if applicable, are invoiced separately.
The applicable price is the one in effect at the time of the sale.
Products must be paid in full at the time of purchase.
Payment methods accepted are specified at the point of sale.
Products remain the property of Jacques Fath Parfums until full payment of the total price, including taxes and additional fees.
In case of order, a deposit may be required depending on the nature of the Product and the point of sale. The balance must be paid upon collection or before delivery.
4. Delivery
Delivery is only available to eligible addresses communicated at the time of purchase.
Delivery costs, including transportation, customs duties, and insurance, where applicable, are borne by the Customer and will be communicated prior to order confirmation.
Risk of loss and damage to Products passes to the Customer upon delivery.
5. Returns and Exchanges
5.1 Purchases Made in France
Customers may return or exchange Products purchased in France within fourteen (14) days of purchase, subject to the following conditions:
Products must be new, unopened, unused, and in their original packaging, including any cellophane or seals intact;
Products must be accompanied by the original receipt or proof of purchase.
5.2 Exceptions
The following Products are non-returnable:
Customized or personalized items;
Items purchased during exceptional sale events.
5.3 Methods
Exchange: If the exchanged Product’s value is higher, you will be required to pay the price difference. If lower, a store credit will be issued.
Store Credit: A store credit valid for thirty (30) days may be issued for returns meeting the conditions above. Store credit is non-refundable and non-transferable.
6. Legal Warranties
Jacques Fath Parfums ensures that Products sold benefit from the following legal guarantees:
6.1 Legal Warranty of Conformity
Under Articles L. 217-3 to L. 217-20 of the French Consumer Code, Customers are entitled to a warranty ensuring that the Product is free from conformity defects.
This warranty covers defects present at the time of delivery for a period of twenty-four (24) months.
6.2 Warranty Against Hidden Defects
Under Articles 1641 to 1649 of the French Civil Code, Customers are protected against hidden defects rendering the Product unfit for its intended use.
This warranty applies for twenty-four (24) months from the discovery of the defect.
6.3 Implementation
Customers may choose between repair, replacement, or reimbursement, depending on feasibility and cost.
7. Commercial Warranty
Certain Products may benefit from an additional commercial warranty, the conditions of which will be communicated at the time of sale.
8. After-Sales Service
Technically repairable Products may benefit from an after-sales service, where applicable.
Terms and costs of the after-sales service will be provided upon request.
9. Transfer of Ownership and Risk
Ownership of the Products passes to the Customer upon full payment of the total price.
Risk transfers to the Customer upon delivery.
10. Intellectual Property
All intellectual property rights attached to the Products, packaging, logos, trademarks, and olfactory creations remain the exclusive property of Panouge SAS or its licensors.
Any unauthorized reproduction or use is prohibited.
11. Personal Data Protection
Your personal information is processed according to applicable data protection laws and our Privacy Policy, available here.
12. Liability
Under no circumstances shall Jacques Fath Parfums be held liable for any damage that does not result from a breach by Jacques Fath Parfums of one of its obligations, including applicable mandatory legal or regulatory provisions.

14. Dispute Resolution – Governing Law
These Terms and Conditions are governed by French law.
In case of dispute, Customers are invited to seek amicable resolution through mediation, notably through the CMAP (Centre de Médiation et d’Arbitrage de Paris), before engaging legal proceedings.
Failing amicable resolution, French courts shall have jurisdiction.
